RWANDA/JUSTICE - MAHAKAMA NCHINI RWANDA YAKATAA KUMWACHIA KWA DHAMANA UWINKIN

 Mahakama mjini Kigali, Jumatano ilikataa ombi la kumwachia kwa dhamana mshitakiwa wa mauaji ya kimbari, Jean Uwinkindi kutokana na kilichoelezwa na mahakama hiyo kuwa ‘’uzito wa mashitaka anayokabiliwa nayo na wasiwasi kwamba huenda atatoroka.’’
Mchungaji Uwinkindi anashitakiwa kwa mauaji ya kimbari na kuteketeza kizazi.Inadaiwa kwamba mchungaji huyo alihamasisha na kuongoza mauaji dhidi ya Watutsi katika parokia yake ya Kayenzi wakati wa mauaji hayo mwaka 1994. 
Mchungaji Uwinkindi alitiwa mbaroni Juni 30, 2010 nchini Uganda na kuhamishiwa makao makuu ya ICTR, mjini Arusha, Tanzania, siku mbili baadaye.Aprili 19, 2012 akawa mshitakiwa wa kwanza wa ICTR, kesi yake kuhamishiwa nchini Rwanda kwenda kusikilizwa katika Mahakama Kuu ya nchi hiyo. Alikana tuhuma zote dhidi yake. 
Baada ya Jaji John Byakatonda kuamuru kwamba mshitakiwa ataendelea kukaa rumande kwa siku 30 zaidi, Wakili kiongozi wa mshitakiwa huyo, Gatera Gashabana alisema kuwa atakata rufaa dhidi ya uamuzi huo.

Kigali, August 29, 2012 (FH) - The Nyamirambo Intermediate Court (Kigali) refused on Wednesday to grant genocide suspect Jean Uwinkindi provisional release, due to the “gravity of the facts allegedly committed and because of the risk that the accused would try to escape justice”.
Uwinkindi is charged with genocide and extermination. He is accused of encouraging and leading the killings of Tutsis in his Kayenzi parish during the 1994 genocide. He was arrested on June 30, 2010 in Uganda. On April 19, 2012, he became the first genocide suspect transferred by the International Criminal Tribunal for Rwanda (ICTR) to Kigali to face trial. He pleads not guilty to all the charges.
After presiding judge John Byakatonda had rendered his verdict, announcing that the accused would stay in custody for 30 more days, Uwinkindi’s lead counsel Gatera Gashabana immediately declared he would appeal the decision.
